The Assam Liquor Prohibition Act of 1952 (Assam Act No. I of 1953) makes it illegal to possess, consume, or manufacture liquor, as well as to smuggle it, in the Barpeta Sub-division and other areas of the state where it’s deemed necessary.<\/p>\n\n\n\n
An Act to prohibit possession, consumption and manufacture of liquor in and of smuggling thereof into the Barpeta sub-division and other areas of the State.<\/em><\/p>\n\n\n\n Prohibition<\/strong>:<\/p>\n\n\n\n No person shall-<\/p>\n\n\n\n (1)<\/strong> transport, import or possess liquor;<\/p>\n\n\n\n (2) <\/strong>sell or buy liquor;<\/p>\n\n\n\n (3) <\/strong>consume liquor except on a permit granted under the provisions of the Act and Rules made thereunder;<\/p>\n\n\n\n (4) <\/strong>manufacture liquor; and<\/p>\n\n\n\n (5) <\/strong>use or keep any material, utensil, implement or apparatus whatsoever for manufacture of liquor :<\/p>\n\n\n\n Provided that for three years from the commencement of the Assam Liquor Prohibition (Amendment) Act, 1956 it shall be lawful for a family of Scheduled Tribes to possess Pachwai to the extent of two-and-a-half seers for the purpose of home consumption.<\/p>\n\n\n\n Punishment for contravention<\/strong>:<\/p>\n\n\n\n If someone goes against the rules in Section 3 of this Act, they could end up in prison for a maximum of two years, but they must serve at least three months. They may also face a fine that can reach one thousand rupees, but it can’t be lower than one hundred rupees.<\/p>\n\n\n\n However, if the person is under 21 years old and has no prior convictions, the court may impose a shorter sentence of less than three months and a fine of less than one hundred rupees.
