The original judgment in 2018 was based on a writ petition filed by a Kerala resident, Joseph Shine.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.gkseries.com\/blog\/current-affairs-quiz-2019-daily-gk\/\" target=\"_blank\" aria-label=\"undefined (opens in a new tab)\" rel=\"noreferrer noopener nofollow\"><strong>Daily Current Affairs Quiz 2020<\/strong><\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Key-Points<\/strong><\/h2>\n\n\n\n<p>The judgment said that the 158-year-old law was unconstitutional and is violative of Article 21 (Right to life and personal liberty) and Article 14 (Right to equality).<\/p>\n\n\n\n<p>The Bench had also held that Section 198 (2) of the CrPC, which gave the cuckolded husband the exclusive right to prosecute his wife\u2019s lover, was manifestly arbitrary.<\/p>\n\n\n\n<p>On the other hand, the verdict had said that adultery can however be a ground for civil remedy like the dissolution of marriage.<\/p>\n\n\n\n<p>The court had reasoned that there was no data whatsoever to support claims that abolition of adultery as a crime would result in \u201cchaos in sexual morality\u201d or an increase of divorce.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A five-judge Review Bench led by Chief Justice of India Sharad A.
