The Cabinet has approved the New\u00a0Delhi\u00a0International Arbitration Centre (NDIAC) Bill, 2019, with a view to promoting ease of doing businessa in\u00a0India.\u00a0The Bill will be introduced in the scheduled Parliament session.<\/p>\n\n\n\n
The Bill seems to be a positive step in establishing an\nindependent and autonomous regime with a well-defined structure for\ninstitutionalized domestic and international arbitration. In a statement, the\ngovernment said it is one of the most important initiatives of the NDA\ngovernment.<\/p>\n\n\n\n
“The\u00a0Union Cabinet\u00a0chaired by\u00a0Prime Minister\u00a0Narendra Modi\u00a0approved the NDIAC Bill, 2019, for introduction in the ensuing session of Parliament”, said the statement.<\/p>\n\n\n\n
According to the government, institutionalized arbitration will\nattract quality experts in India, and as a consequence, it will substantially\nreduce the cost incurred in the process of arbitration, especially at various\ninternational forums.<\/p>\n\n\n\n
“The Bill provides for setting up an independent an autonomous body for institutional arbitration and to acquire and transfer the undertakings of\u00a0International Centre for Alternative Dispute Resolution\u00a0(ICADR) to New\u00a0Delhi\u00a0International Arbitration Centre (NDIAC)”, said the statement.<\/p>\n\n\n\n
The Bill will replace the New\u00a0Delhi\u00a0International Arbitration Centre Ordinance, 2019, promulgated by\u00a0President\u00a0on March 2, 2019, “and saves all the actions done or taken under the Ordinance which will be deemed to have been done or taken under the provisions of this Bill.”<\/p>\n\n\n\n
The Bill will help the government in establishing an independent\nand autonomous institution for resolving International and domestic commercial\ndisputes expeditiously by Alternative Dispute Resolution (ADR) mechanism.<\/p>\n\n\n\n
A High-Level Committee, headed by Justice B.N. Srikrishna, former\u00a0Judge\u00a0of the\u00a0Supreme Court\u00a0of India, had already recommended taking over of the ICADR, established in the year 1995.<\/p>\n\n\n\n
According to the government statement, NDIAC will be headed by a Chairperson, who has been a\u00a0judge\u00a0of the\u00a0Supreme Court\u00a0or a\u00a0judge\u00a0of a high court or an eminent person, having special knowledge and experience in the conduct or administration of arbitration, law or management, to be appointed by the\u00a0Central government\u00a0in consultation with the\u00a0Chief Justice\u00a0of\u00a0India.<\/p>\n\n\n\n
The NDIAC aims to provide facilities and administrative assistance for conciliation, mediation and arbitral proceedings; maintain panels of accredited arbitrators, conciliators and mediators; provide cost-effective and\u00a0timely services\u00a0for the conduct of arbitrations; promote studies in the field of alternative dispute resolution; and co-operate with societies, institutions and organizations promoting alternative dispute resolution.<\/p>\n","protected":false},"excerpt":{"rendered":"
