{"id":2649,"date":"2019-06-22T05:58:10","date_gmt":"2019-06-22T05:58:10","guid":{"rendered":"https:\/\/www.gkseries.com\/blog\/?p=2649"},"modified":"2019-07-12T11:42:40","modified_gmt":"2019-07-12T11:42:40","slug":"fresh-bill-to-ban-triple-talaq-to-be-introduced-in-lok-sabha","status":"publish","type":"post","link":"https:\/\/www.gkseries.com\/blog\/fresh-bill-to-ban-triple-talaq-to-be-introduced-in-lok-sabha\/","title":{"rendered":"Fresh bill to ban Triple Talaq to be introduced in Lok Sabha"},"content":{"rendered":"\n<p>The government introduced the fresh triple <em>talaq <\/em>bill in the Lok\nSabha amid vehement protests by opposition members who claimed that it was\nviolative of the Constitution.<\/p>\n\n\n\n<p>The Muslim Women (Protection of Rights on Marriage) Bill 2019, became the\nfirst legislation to be tabled in Parliament by the Narendra Modi dispensation\nin its second term, with Law Minister Ravi Shankar Prasad asserting the\nlegislation was a must for gender equality and justice. <\/p>\n\n\n\n<p>The bill was introduced following a division of votes, with 186 members\nsupporting and 74 opposing it. \u201cThis is not a question of religion but about\njustice to women,\u201d Prasad said.<\/p>\n\n\n\n<p>Seeking to justify the need to bring in the legislation, Prasad said there\nwere 543 cases of triple <em>talaq <\/em>(instant divorce) reported in the\ncountry. After the Supreme Court judgement banning triple <em>talaq<\/em>\npractise, Prasad said more than 200 cases were reported. \u201cThis is a question of\ndignity of women and we are committed to (safeguard) it,\u201d he said.<\/p>\n\n\n\n<p>He said the job of Parliament was to legislate and it was up to courts to\ninterpret the law.<\/p>\n\n\n\n<p>As soon as Speaker Om Birla asked Prasad to move the bill, several\nopposition members rose in protest and Birla allowed them to put forth their\npoint of view.<\/p>\n\n\n\n<p>Shashi Tharoor of the Congress said he was opposed to triple <em>talaq <\/em>but\nwas against this bill as it conflates civil and criminal laws. He claimed it\nwas a textbook example of class legislation as it was pointed at one community,\nMuslims, even though abandoning wives is not unique to it.<\/p>\n\n\n\n<p>Tharoor said there should be a law universally applicable to all in case of\nabandoning wives.<\/p>\n\n\n\n<p>Asaduddin Owaisi of the AIMIM took a dig at the BJP, saying it has so much\naffection for Muslim women but is opposed to rights of Hindu women to enter\nSabrimala Temple in Kerala. <\/p>\n\n\n\n<p>The triple <em>talaq <\/em>bill violates constitutional rights as it\nstipulates three-year jail term for guilty Muslim men while non-Muslim men get\nonly one year of jail term for a similar offence, he said.
