{"id":3082,"date":"2019-07-02T10:16:30","date_gmt":"2019-07-02T10:16:30","guid":{"rendered":"https:\/\/www.gkseries.com\/blog\/?p=3082"},"modified":"2019-07-12T08:37:10","modified_gmt":"2019-07-12T08:37:10","slug":"reservation-in-teachers-cadre-bill-2019-passes-by-lok-sabha","status":"publish","type":"post","link":"https:\/\/www.gkseries.com\/blog\/reservation-in-teachers-cadre-bill-2019-passes-by-lok-sabha\/","title":{"rendered":"Reservation in Teachers&#8217; Cadre Bill 2019 passes by Lok Sabha"},"content":{"rendered":"\n<p>Lok Sabha on July 1, 2019, passed a bill that proposed to make university or\ncollege as a unit instead of the department for the purpose of providing\nreservation for filling teachers posts in central educational institutions.<\/p>\n\n\n\n<p>The Central Educational Institutions (Reservation in Teachers&#8217; Cadre) Bill\n2019, will allow filling about 8,000 existing vacancies in 41 central\nuniversities and also provides 10 percent reservation for economically weaker\nsections, was introduced to replace an ordinance issued in March this year.<\/p>\n\n\n\n<p>A resolution moved by the Congress leader Adhir Rajan Chowdhury to refer the\nbill to the standing committee was rejected by the House.<\/p>\n\n\n\n<p>HRD Minister Ramesh Pokhriyal &#8216;Nishank&#8217; said the bill will give a major push\nto reforms in the education sector, making it inclusive and fulfilling\naspirations of people from different categories<\/p>\n\n\n\n<p><strong>Congress\nquestions the urgency of the issuing <\/strong><\/p>\n\n\n\n<p>During the debate, opposition members demanded that the Bill be referred to\nthe Standing Committee for a comprehensive review.<\/p>\n\n\n\n<p>Congress leader Adhir Rajan Chowdhury said his party is not opposed to the\ncontents of the Bill but questioned the urgency of issuing an ordinance days\nbefore announcement of Lok Sabha elections.<\/p>\n\n\n\n<p>&#8220;I would oppose invocation of ordinance, this kind of arbitrary\ninvocation of ordinance does not augur well for vibrant democracy,&#8221;\nChowdhury said.<\/p>\n\n\n\n<p>The Minister said the ordinance was issued as the Supreme Court declined to\nconsider the government view and rejected a review petition<\/p>\n\n\n\n<p><strong>Emergence\nof the teacher reservation issue <\/strong><\/p>\n\n\n\n<p>The issue emerges from an April 2017 Allahabad High Court order, in which it\nsaid that for the purpose of reservation for Scheduled Caste and Scheduled\nTribes in universities, an individual department should be considered as the\nbase unit to calculate the number of teaching posts to be reserved. The order\nwas challenged in the Supreme Court, which upheld the HC order. A review\npetition filed by the HRD Ministry in February this year was also dismissed by\nthe apex court.<\/p>\n\n\n\n<p>This led to massive protests from teachers and students across the country\nas it was feared the new system would lower the numbers of reserved seats in\nuniversities.<\/p>\n\n\n\n<p>In March, the Cabinet cleared an ordinance on reservation mechanism for\nappointment of faculties in universities in order to overturn the HC and SC\norders.<\/p>\n\n\n\n<p>Describing this Bill as the beginning of new era in the country\u2019s education\nsector, Ramesh Pokhriyal said, This proposed legislation shows the Prime\nMinister Narendra Modi-led government\u2019s commitment for the welfare of the last\nman in the queue. He also said that those opposing the Bill had exposed their\nlack of commitment to welfare of backward in society.<\/p>\n\n\n\n<p>While moving the Bill for passage, Pokhriyal said it aims to provide for\nreservation of posts in appointments by direct recruitment of person belonging\nto the SC, ST, Socially and Economically Backward Classes and EWS to teachers\u2019\ncadre in certain Central Education Institutions.<\/p>\n\n\n\n<p>He informed the House that there is also provision of 10 percent reservation\nfor EWS in this Bill.<\/p>\n\n\n\n<p>Observing that reservation in the past was only given to socially and educationally backward sections and never to economically backward classes, A Raja (DMK) demanded that 10 percent reservation of EWS should be kept in abeyance and the Bill should be sent to a Parliamentary Committee for scrutiny.<\/p>\n\n\n\n<p><strong>Aim:<\/strong><br>The Bill will reiterate the government\u2019s commitment towards<strong> reservation and to give equal opportunity<\/strong> to all as per the Constitution. This bill will give enough scope and opportunities in higher education sector in the country.<br>The Bill will help fill about 7,000 existing vacancies in 41 Central universities. It aims to provide for reservation in appointments by direct recruitment of persons belonging to the <strong>SC, ST, Socially and Economically Backward Classes and Economically Weaker Sections (EWS) <\/strong>to the teachers\u2019 cadre in certain Central Education Institution.<br><br><strong>Provisions of the Bill:<\/strong><br>The Bill will make<strong> University a unit<\/strong>, rather than a department, for the purpose of providing reservation in teachers\u2019 positions in Central educational institutions.<br>The Bill also has provision for <strong>10% reservation<\/strong> for Economically Weaker Section (EWS).
