It was\nintroduced in the Rajya Sabha on Tuesday by Women and Child Development\nMinister Smriti Irani.<\/p>\n\n\n\n<p>Cutting across party lines, members supported amendments to POCSO Act.<\/p>\n\n\n\n<p>Rising to support the bill, Congress leader Vivek K. Tankha said, \u201cI welcome\nthe Bill. But the stringent provisions are not stopping such incidents.\u201d<\/p>\n\n\n\n<p>He said the National Crime Record Bureau has no data on offences against\nchildren after 2016.<\/p>\n\n\n\n<p>He highlighted the poor conviction rate under the law and said that out of\nover one lakh such offences, trial was completed in around 10,000 cases with\nconviction in 30% cases.<\/p>\n\n\n\n<p>AIADMK leader Vijila Sathyananth also supported the Bill and demanded\nchemical castration of convicts who do such heinous crimes.<\/p>\n\n\n\n<p>She also demanded that the budget allocated by the government under the\nwomen and child development be fully utilised as despite making provision of\ngood amounts, the funds remain largely unutilised.<\/p>\n\n\n\n<p>She also demanded that all public buildings should have close circuit TV\ncameras and the entire expenses on treatment of such victims should be borne by\nthe State.<\/p>\n\n\n\n<p>She said the medical examination of female victims in such cases should be\ndone by lady doctors and that the role of mental health professionals was also\ncrucial.<\/p>\n\n\n\n<p>In an emotionally charged speech, Jaya Bachchan of the Samajwadi Party\nrecalled the Nirbhaya case involving the gangrape-murder of a 23-year-old woman\nin the national capital in December 2012.<\/p>\n\n\n\n<p>She said only amendments will not solve the problem and time-bound\ninvestigation was crucial along with prosecution and proportionate\ncompensation.<\/p>\n\n\n\n<p>Stating that NCPCR was toothless, she said government should provide for an\nindependent national children tribunal.<\/p>\n\n\n\n<p>After the Nirbhaya case very stringent laws were made, special funds were\nallocated but this has not stopped the abuse. In fact the crime rate has\nescalated, Ms. Bachchan said. \u201cWe are looming on a cultural crisis. If our laws\nwere executed well, the scenario would have been different. There is no fear,\nno respect amongst the people today for the law enforcement agencies,\u201d she\nsaid.<\/p>\n\n\n\n<p>She said parents and guardians have the freedom and the right to switch off\ngadgets like television on seeing something vulgar.<\/p>\n\n\n\n<p>I feel that punishment should be proportionate without age being the\nconsideration, Ms. Bachchan added. Recalling the Nirbhaya case, she said, the\nyoungest member among the group who committed the crime was a minor and they\nhad to wait for years to punish him.<\/p>\n\n\n\n<p>Abir Ranjan Biswas of the All India Trinamool Congress said the Bill did not\nconsider observations made by the Madras High Court suggesting that consensual\nsex, physical contact or allied acts after the age of 16 be excluded from the\nPOCSO Act.<\/p>\n\n\n\n<p>He claimed that POCSO Bill was often misused to cover up cases of elopement or inter-caste marriages, suggesting that the Bill should look into the fact that any harassment under the POCSO Bill should be avoided, calling for attempts to curb misuse.<\/p>\n\n\n\n<p>Janata Dal United\u2019s Kahkashan Perween also expressed support for the POCSO Bill, saying it was related to the future of children and once its provisions were enforced, stringent punishment will be meted out to convicts.<\/p>\n\n\n\n<p>She called for awareness campaigns to reach out to women and suggested that\nWomen and Child Development Minister Smriti Irani discuss with Ministry of\nInformation &amp; Broadcasting introduction of legal advice centred around\ncrimes against women and children at the end of various television serials.<\/p>\n\n\n\n<p>Sarojini Hembram of the BJD supported the Bill and said social media and\ntelevision were negatively impacting the minds of children. She said school\nchildren should be educated on a \u2018good touch, bad touch\u2019 and that imparting\nself-defence training was essential.<\/p>\n\n\n\n<p>Supporting the POCSO Bill, B Lingaiah Yadav of the TRS highlighted the incidents of rapes against children and low conviction rates. In such cases, he said, capital punishment should be executed in public and not given in jails.<\/p>\n\n\n\n<p>The Protection of Children from Sexual Offences (Amendment)or  POCSO Bill, 2019 entails amendments to the POCSO Act by including death penalty for aggravated sexual assault on children, besides providing stringent punishments for other crimes against minors. The proposed changes in the Protection of Children from Sexual Offences (POCSO) Act also provide for fines and imprisonment to curb child pornography.<\/p>\n\n\n\n<p>To combat rising cases of child sex abuse, the Union Cabinet earlier this\nmonth approved the amendments.<\/p>\n\n\n\n<p>Jharna Das Baidya (CPI-M) said many a times, victims belonging to poor,\ndalit, and backward classes were not even able to report the matter to police\nand get the FIR done.<\/p>\n\n\n\n<p>Manoj Jha (RJD) there should be a social audit of shelter homes in the\nbackdrop of Muzafarnagar incident in Bihar.<\/p>\n\n\n\n<p>BJP leader Harnath Singh Yadav, Sanjay Raut (SS), TKS Elangovan (DMK),\nShamsher Singh Dullo (Cong), Nazir Ahmad Laway (PDP) and Ravi Prakash Verma\n(SP) also supported the Bill.\n\nSenior Congress member Amee Yagnik said the\namendments were punishment focused and suggested the Bill be sent to a select\ncommittee.\n\n\n\n<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Rajya Sabha passed POCSO Bill 2019 on 24 July, Act by including death penalty for aggravated sexual assault on children, besides providing stringent punishments for other crimes against minors.
