The Bill was tabled by Union Home Minister Amit Shah after announcing that the special status granted to Jammu-Kashmir has been scrapped by modifying Article 370.<\/p>\n\n\n\n<p><strong><a href=\"https:\/\/www.gkseries.com\/blog\/current-affairs-quiz-2019-daily-gk\/\" target=\"_blank\" rel=\"noreferrer noopener\">Daily Current Affairs Quiz 2019<\/a><\/strong><\/p>\n\n\n\n<p>Revoking the special status has been a long-standing demand\nof the BJP that has made it an election promise. The move evoked massive\nprotest from the Opposition which asked the Union government to roll back the\npresidential order.<\/p>\n\n\n\n<p>Speaking in the Rajya Sabha, Shah assured that when \u201cthe\nsituation gets normal and the right time comes\u201d the government is ready to make\nJammu and Kashmir a state again, adding that it may take longer than expected.<\/p>\n\n\n\n<p>The Jammu and Kashmir Reorganisation Bill, 2019 essentially\nproposes to bifurcate the state into two Union Territories \u2014 Ladakh and\nJammu-Kashmir. The Union Territory of Jammu and Kashmir will have a legislative\nassembly, whereas the Union Territory of Ladakh will not have a legislative\nassembly and will be administered by the Lieutenant Governor alone.<\/p>\n\n\n\n<p>-The Union Territory of Ladakh will include the districts\nLeh and Kargil which will, in effect, cease to be part of the existing state of\nJammu and Kashmir. The remaining territories will remain with Jammu and Kashmir\nafter the bifurcation.<\/p>\n\n\n\n<p>-Representation in the House of People: Out of the six Lok\nSabha seats in the state of Jammu and Kashmir, five will remain with the Union\nTerritory of Jammu and Kashmir and one will go to the Union Territory of\nLadakh. The Election Commission may conduct Lok Sabha elections for both the\nUnion Territories as per the allocation of seats specified in the Delimitation\nof Parliamentary Constituencies Order, 1976 as amended by this act.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">About the Union Territory of Jammu and Kashmir<\/h4>\n\n\n\n<p>-The Jammu and Kashmir Legislative Assembly will have a\ntenure of five years unless it\u2019s dissolved earlier by the L-G. Provisions\ncontained under Article 239a of the constitution, that are applicable to\nPuducherry, shall be applicable here as well. This allows the Union Territory\nof Jammu and Kashmir to function as a legislative assembly under an\nadministrator appointed under the said Article. In this case, it will be the\nLG. \u201cTotal number of seats in the Assembly to be filled by persons chosen by\ndirect election shall be 107,\u201d the bill states.<\/p>\n\n\n\n<p>The delimitation of constituencies following the bifurcation\nmay be determined by the Election Commission. The bill states that the number\nof seats in the Legislative Assembly of Jammu and Kashmir shall be increased\nfrom 107 to 114.<\/p>\n\n\n\n<p>-With this, the existing legislative council in Jammu and\nKashmir stands abolished. \u201cEvery member thereof ceases to be such member and\nall bills pending in the Legislative Council shall lapse.\u201d<\/p>\n\n\n\n<p>-Four sitting members of the council of states representing\nthe existing state of Jammu and Kashmir shall be deemed to have been elected to\nfill the seats allocated to the Union Territory of Jammu and Kashmir. Their\nterm of office remaining unaltered.<\/p>\n\n\n\n<p>-The High court of the existing state of Jammu and Kashmir\nwill be the common High Court of the two Union Territories.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">About the Legislative powers of the Union Territory of\nJammu and Kashmir<\/h4>\n\n\n\n<p>-The Legislative Assembly may make laws for the whole or any\npart of the Union Territory of Jammu and Kashmir with respect to any of the\nmatters enumerated in the state list except on subjects \u201cpublic order\u201d and\n\u201cpolice\u201d which will remain in the domain of the Centre vis-a-vis the LG.<\/p>\n\n\n\n<p>-In case of inconsistencies between laws made by Parliament\nand laws made by the Legislative Assembly, earlier law shall prevail and law\nmade by the Legislative Assembly shall be void.<\/p>\n\n\n\n<p>-The role of the Chief Minister will be to communicate to\nthe L-G all decisions of the Council of Ministers relating to the\nadministration of affairs of the Union Territory and proposals for legislation\nand to furnish such information relating to the administration of affairs as\nthe L-G may call for.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">About the Role and powers of the Lieutenant Governor<\/h4>\n\n\n\n<p>\u2013 The Jammu &amp; Kashmir Reorganisation Bill specifies that the Union Territory of Jammu and Kashmir and the Union Territory of Ladakh will have a common Lieutenant Governor. Satya Pal Malik, the Governor of existing state of Jammu and Kashmir, will take over the role of the common L-G \u201cfor such period as may be determined by the President of India.\u201d<\/p>\n\n\n\n<p>\u2013 Appointment of L-G in Ladakh: The President shall appoint\nthe L-G under article 239. The L-G will be assisted by advisors appointed by\nthe Centre since the Union Territory will not have a Legislative Assembly.<\/p>\n\n\n\n<p>\u2013 In the case of Union Territory of Jammu and Kashmir, the\nL-G shall \u201cact in his discretion\u201d on issues which fall outside the purview of\npowers conferred on the Legislative Assembly, in which he is required to\nexercise any judicial functions, and\/or matters related to All India services\nand the Anti-Corruption Bureau<\/p>\n\n\n\n<p><strong>\u2013 The Lieutenant\nGovernor, may if need be-<\/strong><\/p>\n\n\n\n<p>a) prorogue the House<\/p>\n\n\n\n<p>b) dissolve legislative assembly<\/p>\n\n\n\n<p>\u2013 The Chief Minister shall be appointed by the L-G who will\nalso appoint other ministers with the aid of the CM.
