{"id":4555,"date":"2019-08-09T08:51:41","date_gmt":"2019-08-09T08:51:41","guid":{"rendered":"https:\/\/www.gkseries.com\/blog\/?p=4555"},"modified":"2019-08-09T08:51:42","modified_gmt":"2019-08-09T08:51:42","slug":"rajasthan-assembly-passed-a-bill-providing-for-life-imprisonment","status":"publish","type":"post","link":"https:\/\/www.gkseries.com\/blog\/rajasthan-assembly-passed-a-bill-providing-for-life-imprisonment\/","title":{"rendered":"Rajasthan assembly passed a Bill providing for life imprisonment"},"content":{"rendered":"\n<p>The Rajasthan assembly passed a Bill providing for life imprisonment and a fine from \u20b91 lakh to \u20b95 lakh to those convicted in cases of mob lynching leading to victim\u2019s death.<\/p>\n\n\n\n<p><strong><a href=\"https:\/\/www.gkseries.com\/blog\/current-affairs-quiz-2019-daily-gk\/\" target=\"_blank\" rel=\"noreferrer noopener\">Daily Current Affairs Quiz 2019<\/a><\/strong><\/p>\n\n\n\n<p>\u2018The Rajasthan Protection from Lynching Bill, 2019\u2019 was\npassed by the Vidhan Sabha by a voice vote amid vociferous protest by the\nOpposition BJP, which wanted the Bill to be referred to a select committee.<\/p>\n\n\n\n<p>The Bill was introduced by Parliamentary Affairs Minister\nShanti Dhariwal in the state assembly last week.<\/p>\n\n\n\n<p>Responding to the debate on the Bill, Mr. Dhariwal on Monday\ntold the House that the Indian Penal Code and the Criminal Procedure Code have\nprovisions to deal with the cases of mob lynching incidents, they are not adequate.<\/p>\n\n\n\n<p>Accordingly, the government has brought the Bill to provide\nfor stricter punishment to curb such incidents.<\/p>\n\n\n\n<p>Mentioning the Supreme Court\u2019s recommendation to enact a law\nagainst the incidents of mob lynching, the statement of objects and reasons of\nthe Bill said, \u201cIt is proposed to nip the evil in the bud and to prevent\nspreading of hatred or incitement to mob lynching by creating special offences\nagainst such acts.\u201d<\/p>\n\n\n\n<p>Chief minister Ashok Gehlot had announced his government\u2019s\nintention to enact the law while replying to the debate on the State Budget on\nJuly 16.<\/p>\n\n\n\n<p>In his reply, Mr. Dhariwal told the House that the Bill was\nintroduced to ensure that the incidents of mob lynching are not repeated in the\nState. \u201cAfter 2014, 86% cases of mob lynching reported in the country happened\nin Rajasthan. The State is considered a peaceful State and such incidents have\nput a blot on it,\u201d he said.<\/p>\n\n\n\n<p>The Opposition legislators collectively protested against\nthe Bill saying they will not support it in its present form and demanded it to\nbe sent to a select committee for review.<\/p>\n\n\n\n<p>Leader of Opposition Gulab Chand Kataria said the Supreme\nCourt had given several guidelines while hearing cases related to the mob\nlynching but the state government considered its only one suggestion of\nenacting a law.<\/p>\n\n\n\n<p>Pointing out that the IPC and CrPC have ample provisions to\ndeal with the cases of mob lynching, Mr. Kataria demanded from the government\nto table relevant statistics in the House on cases of mob lynching in the state\nto justify the new law.<\/p>\n\n\n\n<p>\u201cThe State government should not bring such a strict law in\na hurry. The Bill should be sent to a select committee where we will sit and\ndiscuss on all issues and support it in all manners, but we will not support\nthe Bill in its present form,\u201d he said.<\/p>\n\n\n\n<p>The Bill defines the mob as a group of two or more\nindividuals.<\/p>\n\n\n\n<p>It also defines lynching as &#8220;an act or series of acts\nof violence or those of aiding, abetting or attempting an act of violence,\nwhether spontaneous or preplanned, by a mob on the grounds of religion, race,\ncaste, sex, place of birth, language, dietary practices, sexual orientation,\npolitical affiliation or ethnicity&#8221;.<\/p>\n\n\n\n<p>For the offence of an assault by mob, leading to the victim\nsuffering grievous hurts, the Bill provides for jail terms up to 10 years and a\nfine of \u20b925,000 to \u20b93 lakh.<\/p>\n\n\n\n<p>In cases of the victims suffering simple injuries, the Bill\nproposes imprisonment up to seven years and a fine up to \u20b91 lakh.<\/p>\n\n\n\n<p>For hatching a conspiracy of lynching or aiding, abetting or\nattempting such an offence, the Bill seeks to punish the offenders in the same\nmanner as if he actually committed the offence of lynching.<\/p>\n\n\n\n<p>The Bill also empowers the State police chief to appoint a\nstate coordinator of the rank of Inspector General of Police to prevent the\nincidents of lynching in the State with the district Superintendents of Police\nacting as the district\u2019s coordinator, to be assisted by a Deputy\nSuperintendents of Police, for taking measures to prevent incidents of mob violence\nand lynching.<\/p>\n\n\n\n<p>The Bill also enlists various other offences related to the\nlynching such as dissemination of offensive materials, propagation of hostile\nenvironment and obstructing legal processes, which would be punishable with\njail terms varying from three to five years.<\/p>\n\n\n\n<p>The Bill also stipulates the provision of compensation to\nvictims by the State government as per the Rajasthan Victim Compensation\nScheme.<\/p>\n\n\n\n<p>It also binds the State government to take necessary\nmeasures to rehabilitate the victims of mob lynching, suffering displacements\nfrom their native places.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Rajasthan assembly passed a Bill providing for life imprisonment and a fine from \u20b91 lakh to \u20b95 lakh to those convicted in cases of mob lynching leading to victim\u2019s death.
