Correlation between the fundamental rights and duties of citizens

Correlation between the fundamental rights and duties of citizens

The Correlation between fundamental rights and duties of citizens is a very debatable issue. The idea of correlation between the fundamental rights and duties has been the subject matter of various debates for many years but still it stands as a debatable issue in different circumstances.  For the last two decades there has been a strong debate between different schools of thoughts about the necessity of having fundamental duties. The point at issue is whether rights have real meaning, if individuals perform duties.

Correlation between fundamental rights and duties

Respect for others rights: Rights and duties are closely related but the relationship is not one of equality. Duties generally outweigh rights. For instance, though we have a right to life, it becomes our duty to respect the right of others to live. The same holds true for respecting an individual's freedom of expression. In India, we have a right to free speech but it should be used responsibly.

Reminder: Duties and rights are two sides of the same coin. Rights ensure that individuals can use their freedom to enjoy and practice values and norms historically embedded in a country. Rights are enjoyed by citizens only after they fulfill their duties towards the society, country and state. Duties serve as a reminder to the citizens that while enjoying their rights, they should also be conscious of duties they owe to their country, their society and to their fellow citizens.

Balance privileges and obligations: Fundamental rights, duties and prohibitions laid down in the Constitution of India are called fundamental because they are so basic and innate. They do not depend on each other for their existence. Fundamental duty corresponds to fundamental In other words, they complement each other. A dutyrecognises and enforces a perfect balance between obligation towards a society and privileges of an individual.

Social benefit: Fundamental duties serve as a warning against the anti-national and antisocial activities like burning the national flag, destroying public property and so on. As an individual has every right to live with dignity, it is the duty of every citizen to not destroy national property which provides services to the whole nation.

Close relationship: The relationship between the fundamental rights and duties of citizens is close and inseparable. Both rights and duties are inseparable from the essence of the legal system. It means that if a given legal system provides its citizens with a fair personality and property, it imposes responsibilities on them to respect this order, as well as to respect the life and property of other citizens. Therefore, a strong legal system consists of fundamental rights and duties like two wings extending parallel to each other, or they are interconnected and mutually dependent on each other.

Establish a democratic balance: The balance among the duty and right of individuals, should be based on the moral value which is contained in these duties and rights. These duties and rights have to be treated equally. These duties should establish a democratic balance by making people conscious of their equal rights as well as their duties. The fundamental rights and duties of citizens, aim to achieve a situation where human beings are sovereign over other creatures. This helps in establishing a democratic balance by making the people conscious of the duties contained in the rights they have achieved by making them aware of their responsibilities at the same time.
